Terms of Service

These Terms of Service ("Terms") govern your use of the Kiln mobile application ("Kiln", "the App") operated by Wolstapp ("we", "us", "our"). By downloading, installing, or using Kiln, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Kiln, you confirm that you:

• Are at least 13 years old (or 16 in the EEA)
• Have read, understood, and agree to these Terms
• Have read and agree to our Privacy Policy

If you do not agree to these Terms, do not use the App.

2. Description of Service

Kiln is a fitness tracking application that allows you to:

• Create structured workout programs with phases and schedules
• Log workout sessions including exercises, sets, repetitions, and weights
• Track body measurements over time
• View training history and progress

The App is provided free of charge. We reserve the right to introduce paid features or subscriptions in the future, with reasonable notice.

3. Your Account

You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us promptly of any unauthorised use of your account

You may only create one account per person. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' data
• Reverse-engineer, decompile, or disassemble the App
• Use automated tools to access or scrape the App
• Upload malicious content or interfere with the App's operation
• Impersonate another person or entity

5. Your Content

You retain ownership of all data you enter into Kiln, including workout logs, programs, templates, and body measurements ("Your Content").

By using the App, you grant us a limited licence to store, process, and transmit Your Content solely for the purpose of providing and improving the service. We will not use Your Content for any other purpose without your consent.

6. Health and Fitness Disclaimer

Kiln is not a medical device and does not provide medical advice.

The App is a fitness tracking tool only. It does not diagnose, treat, cure, or prevent any medical condition. Information displayed in Kiln (including workout suggestions, progress metrics, and body measurement trends) is for informational purposes only.

You should:

• Consult a qualified healthcare professional before starting any exercise programme
• Stop exercising immediately if you feel pain, dizziness, or discomfort
• Not rely solely on the App for health or fitness decisions

We are not liable for any injury, health issue, or adverse effect resulting from workouts performed while using Kiln. You exercise at your own risk.

7. Availability and Updates

We aim to keep Kiln available at all times, but we do not guarantee uninterrupted service. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We may release updates to the App from time to time. Some updates may be delivered automatically. Continued use of the App after an update constitutes acceptance of any changes.

8. Offline Functionality

Kiln is designed to work offline. Data entered while offline is stored locally on your device and will sync to our servers when connectivity is restored. We are not responsible for data loss caused by device failure, operating system issues, or other factors outside our control while data remains unsynced.

9. Account Deletion

You may delete your account at any time from the Settings screen within the App. Account deletion:

• Permanently removes all your data from our servers
• Clears all local data from your device
• Is irreversible — deleted data cannot be recovered

We may also terminate your account if you violate these Terms, with notice where reasonably possible.

10. Intellectual Property

The App, including its design, code, branding, icons, and the Ember character, are the intellectual property of Wolstapp. You may not copy, modify, distribute, or create derivative works from any part of the App without our written permission.

The exercise library included in Kiln is provided for your personal use within the App only.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Kiln is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We do not warrant that the App will be error-free, secure, or available at all times
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability for any claim related to the App shall not exceed the amount you paid us in the 12 months preceding the claim (or zero, if the App was free)

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence.

12. Indemnification

You agree to indemnify and hold harmless Wolstapp from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union, you retain any mandatory protections provided by the law of your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

If you disagree with any changes, you should stop using the App and delete your account.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
